1. Data controller

Under Turkish Personal Data Protection Law No. 6698 (“KVKK”), the data controller for data-processing activities on this website is stated as Ayvalık FM (operator of the ayvalikfm.com website) is stated as the data controller.

2. Categories of data processed and method of collection

Data may be collected electronically and automatically while the website and connected services are used.

• Technical operation/security data: IP address, browser/device information, access time and standard server logs.
• Preference data: Local preferences stored in the browser, such as the selected radio channel.
• Gediz AI content: Messages written by the user to Gediz, the technical session ID and the short session history used for the chat to function.

Users are advised not to enter sensitive personal data, financial information, passwords or unnecessary personal information into Gediz.

3. Purposes and legal grounds for processing

Personal data may be processed in a limited and proportionate manner for operating digital radio and site services, ensuring security, preventing errors and misuse, remembering user preferences and responding to requests sent through Gediz AI.

Depending on the specific processing activity, these activities may rely on the lawful processing conditions set out in Article 5 of the KVKK, particularly where processing is necessary for the legitimate interests of the data controller. If a new operation requiring explicit consent by law is introduced, it will not begin without obtaining that consent.

4. Categories of recipients to whom data may be transferred

To the extent technically necessary, data may be processed by or shared with hosting, radio broadcasting, security and artificial-intelligence infrastructure providers. In addition, if a visitor uses third-party images, weather/sea data or social-media links, technical connection data may reach the relevant service providers.

Some infrastructure used by third-party services may be hosted outside Turkey. Where such a transfer occurs, compliance with the applicable KVKK provisions is required.

5. Your rights under the KVKK

Under Article 11 of the KVKK, you may make a request concerning your personal data in relation to the following matters:

• To learn whether your personal data has been processed and, if so, request information,
• To learn the purpose of processing and whether data is used in accordance with that purpose,
• To learn the third parties in Turkey or abroad to whom data has been transferred,
• To request correction of incomplete or incorrectly processed data,
• To request deletion or destruction when the legal conditions are met,
• To request notification of correction/deletion operations to third parties to whom the data was transferred,
• To object to an adverse result arising from automated systems,
• To claim compensation if you suffer damage due to unlawful processing.

6. How to submit a request

You may submit requests under the KVKK in writing to the Ayvalık / Balıkesir address above, clearly stating your identity and request and using one of the application methods prescribed by law. Requests are evaluated within the periods and procedures provided by applicable legislation.
